What’s In a Name? The Ban on Registering Disparaging Trademarks is Struck Down

Simon Shiao Tam sought to register his band name, THE SLANTS, with the United States Patent and Trademark Office (“PTO”) but was denied registration when the PTO found the mark to be disparaging to persons of Asian descent. On appeal, the Federal Circuit held that the Lanham Act provision barring registration of disparaging trademarks is unconstitutional under the First Amendment. While disparaging marks may offend members of the community, the Federal Circuit held that denying registration to such marks based upon the message they convey simply fails to pass constitutional muster. The decision is not only likely to lead to an increase in trademark applications for offensive and disparaging marks, it also opens the door for others to argue that restrictions against registering “immoral” and “scandalous” trademarks are likewise unconstitutional.

Trademark attorney Josh Saltz successfully defends caracol.com in re-filed UDRP

Caracol.com (Spanish for “snail”) came under attack for the second time when in 2015 Caracol Primera Cadena Radial Colombiana S.A. (“Caracol Primera”) re-filed a Complaint under the Uniform Domain Name Dispute Resolution Policy (“UDRP”) seeking a transfer of the domain. Twelve years earlier, Caracol Primera filed a similar Complaint under the UDRP which was denied for failure to prove that the domain was registered in bad faith. Attempting another bite at the apple, Caracol Primera argued that a 2015 offer by Respondent’s domain name broker to sell the domain to Caracol Primera suggested bad faith. In a detailed decision discussing the heightened standard for re-filed UDRP cases and the sale offer that came nearly eighteen (18) years after the domain was registered, the three member panel once again found that bad faith registration was not shown and denied the Complaint.

Because there was no official verdict in the case, it does not set any legal precedent for future lawsuits. But Miami attorneys Steven Peretz and Michael Chesal, who are experts on trademark law but were not involved in the Coach case, said they thought the case was a win for Coach.

"This gives Coach and other luxury brands another arrow in their quiver in trying to enforce their branding and trademark rights against flea market operators and shopping malls," Peretz said.

Because damages can run anywhere from $1,000 to $2 million per infringement, it's impossible for defendants to predict how much it could cost them to fight such litigation, Peretz and Chesal said.

"It's like running a red light and not knowing if the fine could be $100 or $10,000," Peretz said.

Peretz Chesal & Herrmann is pleased to announce that Josh Saltz and Moish Peltz have joined the firm as associate attorneys. Mr. Saltz practices trademark, copyright, licensing, social media and Internet law. He has worked with small Internet startups to global brands with billions in revenue. Prior to joining PCH, Mr. Saltz worked for Sequel Technology & IP Law/eCrimetools.com in Washington, DC, where he led the domain name brand monitoring and enforcement program for a worldwide women’s apparel brand and secured the transfer of more than 100 domain names under the Uniform Domain Name Dispute Resolution Procedure ("UDRP"). He received his master of laws in Intellectual Property Law from The George Washington University School of Law in 2010, after graduating magna cum laude from the Florida Coastal School of Law in 2009.

Mr. Peltz practices intellectual property law involving both transactional and litigation matters, including brand management, technology and entertainment law. Mr. Peltz earned his juris doctor from the University of Florida Levin College of Law in 2012, with a Certificate in Intellectual Property Law. In 2011, he served as an intern at the World Intellectual Property Organization (the specialized intellectual property agency of the United Nations), focusing on intellectual property and international law. Peretz Presents on In re Bilsky at Florida Bar

Steven Peretz spoke as a panelist at the meeting of The Florida Bar’s Intellectual Property Law Committee held in Naples, Florida on September 6, 2010 as part of the Business Law Section’s Annual Retreat.  The three panelists covered the impact of the Supreme Court’s recent decision In re Bilsky in which the Court addressed the scope of method patents.  Steven’s presentation focused on the recent trend in Supreme Court decisions to narrow the rights of patent holders.

Leora Herrmann Co-Chaired the highly successful Florida Bar First Annual IP Symposium held in Tampa, Florida on March 25- 26, 2010, an advanced continuing legal education conference which drew speakers from across the country and garnered the highest attendance of any CLE program in The Florida Bar Intellectual Property Committee’s history.  Featured speakers included David Carson, General Counsel of the U.S. Copyright Office. Leora will co-chair the IP Symposium again in 2011.
